Terms of Service

These terms govern your use of the Klai platform, operated by Klai B.V. (“Klai”, “we”, “us”), incorporated in the Netherlands. By creating an account or using the platform, you agree to these terms.

1. The service

Klai provides private AI infrastructure for professional use: AI chat, document analysis, and transcription. Access is by subscription.

2. Your account

You are responsible for keeping your login credentials confidential and for everything that happens under your account. If you suspect unauthorised access, contact us at hello@getklai.com immediately.

You may not:

  • Share your account with people outside your subscription tier
  • Use the service to process data you are not authorised to handle
  • Attempt to bypass access controls or technical restrictions

3. Acceptable use

The service is for lawful professional use. You may not use it to:

  • Process data in violation of applicable law, including GDPR
  • Generate content that is unlawful, harmful, or deceptive
  • Reverse engineer the system or attempt to extract model weights
  • Run automated scraping or load testing without prior written agreement

4. Data and privacy

How we handle your data is described in our Privacy Policy. Where you are sending us personal data on behalf of your clients or colleagues, the Data Processing Agreement also applies.

We do not use your data to train AI models. Your data stays in the EU.

5. Subscription and payment

Subscriptions are billed monthly or annually, as chosen at signup. Prices exclude VAT unless stated otherwise.

You can cancel at any time. Cancellation takes effect at the end of the current billing period. We do not refund partial periods.

If we change our pricing, we will give you 30 days’ notice. If you do not accept the change, you can cancel without penalty.

6. Availability

We aim for high availability but cannot guarantee it. Scheduled maintenance will be announced in advance where possible.

7. Intellectual property

Klai is built on open source software. The platform code is open source and auditable. Details of the components we use are in the sub-processor documentation.

Your content stays yours. You grant us no rights to your data beyond what is needed to run the service.

8. Limitation of liability

To the extent permitted by law, Klai is not liable for indirect or consequential damages from your use of the service.

Our total liability for any claim under these terms is capped at the amount you paid us in the three months before the claim arose.

9. Governing law

These terms are governed by Dutch law. Disputes go to the competent court in Groningen.
